Wrongful Death Cases
Wrongful Death - Failure to Diagnose Colon Cancer
Our client, a 85-year-old woman who had a history of weight loss and stomach
illness, which were untreated by her physician, until she was ultimately
diagnosed with colon cancer from which she ultimately died. Settlement
confidential.
Wrongful Death - Failure to Diagnose Myocardial Infarction
Our client, a 54-year-old man, who had a history of diabetes and hypertension,
was seen by his internist for what was diagnosed as an upper respiratory
infection. The patient was later seen and an ECG revealed a myocardial
infarction, and the patient was admitted to the hospital and thereafter
died from complications and congestive heart failure. Settlement

Wrongful Death - Failure to Diagnose Neurological Condition -
Acute Disseminated Encephalomyelitis (ADEM)
Our client was a 10-year-old child who had been admitted to the hospital
with neurological symptoms on her left side as well as vomiting and flu-like
symptoms. The child was discharged with diagnosis of a viral infection.
Her conditions worsened over the next two days, and the child was re-admitted
to the hospital where an MRI revealed what was later diagnosed as acute
disseminated encephalomyelitis (ADEM). The child thereafter died. Settlement

Wrongful Death - Failure to Diagnose Myocardial Infarction
Our client, a 68-year-old woman, was admitted into the hospital with shortness
of breath upon exertion. The patient was discharged with a thoracic strain.
Over the next several days, the patient's condition worsened and she was
re-admitted five days later with severe chest pains and severe shortness
of breath. The patient died from a myocardial infarction. Settlement

Medical Malpractice Cases
Failure to Diagnose and Treat Lyme's Disease
Our client, a 42-year-old woman, received an insect bite and sought medical
treatment from a series of physicians which failed to diagnose and promptly
treat her condition of Lyme's Disease with early antibiotic treatment.

Laparoscopic Cholecystectomy and Bile Duct Injury
Our client was a 75-year-old man who underwent a laparoscopic cholecystectomy
at a Veterans Hospital, and during the laparoscopic procedure an injury
occurred to the common bile duct. Subsequent surgeries were required,
including a roux-en-y choledochojejunostomy. The client had numerous bouts
of sepsis and hospitalizations. Settlement under Federal Torts
Claim.
Failure to Diagnose Staphylococcus Aureus Infection
Our client, a minor child, was born prematurely and discharged from an
area hospital. She thereafter returned to her pediatrician's office following
her discharge with swelling in her lower extremity. A delay occurred,
and then when the child was re-admitted to the hospital, the staphylococcus
aureus infection was diagnosed and developed into osteomyelitis into her
femur and ankle. Settlement confidential.
Failure to Diagnose Auto Immune Inner Ear Disease and Otosclerosis
Our client was a 41-year-old woman who had auto immune inner ear disease.
An otolaryngologist performed a stapendectomy on her ear, which resulted
in deafness. Jury trial resulted in a verdict of $2.6 million
dollars.
Failure to Perform Pericardiocentesis in a Timely Manner
Our client and parents involving a minor child who underwent a cardiac
angioplasty procedure which resulted in an injury to the aorta, and the
child developed cardiac tamponade, resulting in extreme hypoxia ischemia
encephalopathy from failure to perform pericardiocentesis in a timely
manner. Settlement confidential.
Negligent Prescription and Combination of Medication Causing
Patient's Suicide
Client died from suicide from what was alleged to by a prescribed overdose
of medication and improper combination of medicines contributing to person's
suicide. Settlement under Federal Torts Claim Act.
Nursing Home Cases
Nursing Home Neglect
Client was a 90-year-old patient of a nursing home who fell from a bed,
resulting in a fractured hip. Client later fell again, resulting in fractured
tibia. Settlement confidential.
Nursing Home Employee's Abuse of Patient
Our client was severely injured when he was a patient at a nursing home.
It was contended that he was physically abused by an employee of the nursing
facility. Lawsuit was filed alleging improper care and treatment and improper
supervision by someone who was not qualified to render care and treatment.

Auto Cases
Automobile Collision
Our client, a 39-year-old man, was involved in a car collision as another
vehicle moved over an intersection failing to yield. Injuries involved
soft tissue and lower back. Settlement of policy limits of $100,000.00.
Automobile Collision
Our client, a 51-year-old woman, was involved in a car collision when
the Defendant rear-ended our client's vehicle. Injuries involved soft
tissue and lower back. Settlement of policy limits of $100,000.00.
Automobile Collision
Our client, a 63-year-old man, was traveling on an interstate highway
when a tractor trailer slowed and made a turn on an interstate crossover,
causing a collision with our client. Our client suffered soft tissue injuries
and a fractured sternum. Jury verdict of $200,000.00.
Automobile Collision
Our client and his wife and daughter were traveling on a country road
and were struck in the side by a defendant driver, resulting in connective
soft tissue injuries to the husband, loss of consortium claimed by the
wife, and an injury to the child. Jury verdict of $155,000.00.
Automobile Collision - RSD Injuries
Our client, a 61-year-old woman, who was struck by a school bus backing
up on a street, backed in the client's vehicle, causing an injury to her
arm, which ultimately resulted in the client being diagnosed with Reflex
Sympathetic Dystrophy (RSD). Settlement $250,000.00.
Automobile Collision
Our client and his spouse were traveling on a country road and were struck
in the side by the defendant driver, resulting in the death of the spouse
and severely injuring the client. The case was settled for policy
limits.
Consumer Fraud Cases
Consumer Fraud - Fraud and Misrepresentation
Our clients had purchased a vehicle from the Defendants, and the Defendants
failed to disclose the condition of the vehicle, including its prior use
as a rental car. Plaintiffs claimed fraud, misrepresentation, and diminution
in value. Jury verdict of $48,000.00.
Consumer Fraud - Fraud and Misrepresentation
Our clients had purchased a vehicle from the Defendants, and the Defendants
failed to disclose the condition of the vehicle in terms of the prior
salvage and/or scrap title that existed on the vehicle. Plaintiffs claimed
loss of use of vehicle and fraud and misrepresentation regarding the sale
of the vehicle. Settlement - $95,000.00
Conversion
Our clients purchased a vehicle from the local car dealership and thereafter
took the vehicle home for a test drive, leaving their car at the dealership.
When they returned the next day, they were advised that their car had
been sold, which forced her to buy the vehicle she had test drove. The
case was tried for Plaintiff's claim of conversion resulting in a jury
award of $100,000.00 punitive damages and $8,000.00 actual damages.
Workers' Compensation Cases
Workers' Compensation
Our client's spouse died as a result of a one-car accident after he had
left a business on his way home. The employee was a salesman for an alcohol
distributing company and part of his job involved selling and promoting
alcoholic beverages. The employee had been drinking at the time of the
collision. Trial at the Division of Workers' Compensation and appeal ultimately
resulted in workers' compensation benefits to the spouse for her lifetime
and for her minor child during the child's minority. Past and
future benefits in excess of $750,000.00.
