Kansas City Slip and Fall Accident Lawyers

Accidents of the “slip and fall” variety are those in which a person sustains injury by slipping, or tripping, and falling as a result dangerous conditions on a property/premises. These types of falls may happen inside or outside of a building. Common causes of slip-and-fall-accidents include poor or wet flooring, bad lighting around steps and walkways, and weather-related hazards.

Negligence law covers all slip and fall accidents. Premises liability states that property owners are bound by a “duty of care,” to ensure that their property is safe for visitors. This duty extends from structural issues to flooring, lighting, standing water, damaged concrete or other walkway material, and all other aspects of premises. Any entrant onto a premises is bound by a comparable duty to act reasonable and sensibly, avoiding carelessness, recklessness, and unnecessary risk. Failure to abide by this duty may mean that a plaintiff ultimately shares in the negligence with the propertyowner.

After a slip and fall accident:

  1. Attempt to determine what caused you to fall. Could it have been anticipated or prevented?
  2. Take down contact information of any and all witnesses present.
  3. Note the conditions around the area – poor lighting? A slippery substance on the ground? Anything else that contributed to the fall?
  4. If a substance was on the ground, attempt to obtain a sample.
  5. If possible, take pictures of the area.
  6. Report any incidents to the manager or owner and insist on he/she making a record of it.
