Can I sue a gym for deadlift-related injuries?

She claims she was told to do it “too quickly and in an unsafe manner”. 

In its defense, CrossFit denied responsibility and claimed that not only did she allegedly “not seek medical attention until five weeks after the incident” but she also reportedly didn’t tell her doctor about the gym incident when she finally did complain of back pain. The defense further argued she didn’t disclose to their staff that she allegedly had prior back problems– and if she had, she would not have been permitted to perform a deadlift. 

While the jury in the above case found in favor of CrossFit, another gym member in a separate deadlift-related lawsuit in Missouri reportedly won a $400,000 jury verdict against CrossFit.

The different outcomes in these two Missouri deadlift-related litigation cases may be attributable at least in part to the actions or omissions of the injured parties after the alleged incidents.
