Can I sue a gym for deadlift-related injuries?

Missouri personal injury attorneys know that the outcomes of deadlift-related lawsuits against gyms by injured members can be hit-or-miss depending on the facts of each case and possibly, how soon an attorney is contacted.
To recover in a personal injury action, the injured party must first establish that the negligent, reckless, or intentional actions or inactions of another person or entity caused their injury. Once liability is established, compensatory damages may be awarded. Damages vary on a case-by-case basis and may include such items as current and future medical expenses and/or lost income or diminished earning capacity, physical and psychological pain, and more.

Reportedly, gym-giant company, CrossFit, has a deadlift training regimen offered in over 10,000 independently-owned gyms worldwide. A Missouri woman sued CrossFit claiming “a weightlifting coach’s inadequate training caused her to suffer a herniated disk” the first time she attempted to perform a deadlift. She claims she was told to do it “too quickly and in an unsafe manner”.

In its defense, CrossFit denied responsibility and claimed that not only did she allegedly “not seek medical attention until five weeks after the incident” but she also reportedly didn’t tell her doctor about the gym incident when she finally did complain of back pain. The defense further argued she didn’t disclose to their staff that she allegedly had prior back problems– and if she had, she would not have been permitted to perform a deadlift.

While the jury in the above case found in favor of CrossFit, another gym member in a separate deadlift-related lawsuit in Missouri reportedly won a $400,000 jury verdict against CrossFit.

The different outcomes in these two Missouri deadlift-related litigation cases may be attributable at least in part to the actions or omissions of the injured parties after the alleged incidents. That’s why it’s important to consult a skilled personal injury attorney as soon as possible after you have been hurt in any kind of accident to avoid jeopardizing your chances for recovery.
