Can I sue for damages if a tainted baby powder caused my cancer?

Multiple lawsuits and verdicts indicate that there is no dusting this alleged problem under the rug.

Missouri product defect attorneys predicted that flood gates of talc litigation suits would follow the 2018 monumental jury trial verdict ordering industry giant Johnson & Johnson “to pay for $4.69 billion to 22 women who blamed their ovarian cancer on asbestos in its talc products”. Now, another woman who is dying of cancer was just awarded $29 million in a different lawsuit. She claimed her cancer was caused by her long-term use of Johnson & Johnson’s baby powder which she, too, alleged was tainted with the carcinogen asbestos.

At the crux of these lawsuits are allegations that “internal documents” indicated the company has known the talc was tainted for four decades and the “baby powder mined...contained trace amounts of asbestos but failed to alert consumers or regulators”.  There are still over 13,000 lawsuits against the company alleging the baby powder caused plaintiffs’ mesothelioma or ovarian cancer. J&J has been vehemently defending these suits and appealing verdicts.

Defective products claims fall within the realm of personal injury law. In essence, defective product claims arise when someone is injured buy a dangerous product due to a design defect, manufacturing error, or inadequate labeling that fails to include sufficient safety instructions or warnings.
